Virtual Items

What you get when you earn or buy something in Dusk Lord, including mounts bought with real money. This policy is part of the Terms of Service and should be read with Sections 10 and 11 of them.

1.What a Virtual Item is

"Virtual Items" means everything in the game that can be held, earned, granted or bought: gold, items, equipment, materials, mounts, settlements and their buildings, guild halls, characters, levels, skills and titles.

• A Virtual Item is not property. It is a limited, personal, revocable, non-transferable licence to use a feature of the game. You do not own any account, character, item or currency.
• Virtual Items have no monetary value. Gold is not money, legal tender, a deposit, a stored-value or prepaid product, or a security. It cannot be exchanged for cash or anything of real-world value, and is not insured or guaranteed by anyone.
• Each server is its own world. A character, and what it holds, stays on the server where it was made, and cannot be moved to another.

2.What we may change

The game is under active development and is balanced continuously. We may at any time, with or without notice, and without liability or compensation except where the law requires otherwise:

• Change an item's statistics, look, rarity or how it is obtained;
• Rebalance or devalue any item, currency, price or drop rate;
• Remove an item or game system;
• Take back Virtual Items obtained through a bug, exploit, bot, chargeback, fraud or a breach of the Code of Conduct;
• Reset, roll back or wipe the world, characters or progress;
• Forfeit everything on an account we suspend or close.

Buying something with real money does not exempt it from any of this. A purchase buys access to a feature of the game as it is, not a permanent or unchanging asset.

3.Mounts bought with real money

The game has a store for optional mounts that can be bought with real money. When it is open:

• You must be 18 or older to buy. Players under 18 must not make purchases, and a purchase made by someone under 18 may be cancelled.
• Prices are in US dollars and are shown before you pay. Payment is handled by Helcim Inc.; see the Refund & Payment Policy.
• The mount is delivered in the game to the account that bought it, once the payment is confirmed.
• A bought mount is a Virtual Item like any other: it has no cash value, cannot be sold or transferred for real money, and is subject to Section 2.
• We do not sell randomised items (loot boxes) for real money. What you pay for is exactly what you get.

Random drops from monsters, gathering and the like are part of normal play, cost no money, and can change at any time.

4.No cash-out, no real-money trading

Virtual Items may only be moved within the game, using the game's own trading, mail, market and guild features. You must not sell, buy, auction, rent or exchange Virtual Items or accounts for real money, cryptocurrency, gift cards or anything else of real-world value, directly or through any other site. Doing so breaches the Code of Conduct and can lead to confiscation and closure of every account involved, buyer and seller alike. Nothing in the game is a token, NFT, blockchain asset or investment.

5.Minors and purchases

If a minor made a purchase on your payment method without your permission, contact [email protected] promptly; see the Refund & Payment Policy. Keep payment details out of children's reach.

6.When your licence ends

Your licence in every Virtual Item ends, without refund or compensation except where the law requires otherwise, when you ask us to delete your account, when we close it under the Terms, when it is deleted after long inactivity, or when the Service ends. Virtual Items cannot be inherited or transferred on death, divorce, insolvency or by operation of law.

7.Your statutory rights

Nothing in this policy removes a right you have under consumer protection law that cannot be waived, including British Columbia's Business Practices and Consumer Protection Act or the consumer law of where you live. Where such a right applies, it prevails over anything inconsistent here.
